Terms and Conditions

Clear terms for using Connectix.

These Terms and Conditions explain the rules that apply when you use the Connectix website, create or use a Connectix account, access Connectix WiFi, buy or sell Connectix tokens, host a connection point, or use related connectivity services.

A practical service needs clear rules

Connectix is designed to make internet access and connectivity easier to reach. These terms set out the responsibilities that help users, agents, resellers and Connectix use the service consistently and fairly.

01

Acceptance of these terms

By creating or using a Connectix account, accessing Connectix WiFi, purchasing or redeeming a Connectix token, acting as an authorised agent or reseller, or otherwise using a Connectix service, you agree to these Terms and Conditions.

If you use Connectix on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

If you do not agree with these terms, you should not create an account, purchase or redeem a token, or use the affected Connectix service.

Nothing in these terms removes any right or protection that cannot lawfully be excluded under applicable law.

02

Connectix services

Connectix provides internet access and related connectivity services. These may include WiFi access, distributed connection points, account services, token services, network setup, managed connectivity and support.

The exact services available at a location may differ according to network coverage, infrastructure, technical feasibility, local operating conditions and the service selected.

Specific service descriptions, token conditions, account features or separate written agreements may form part of your agreement with Connectix. Where a separate written agreement applies to a particular service, that agreement will apply together with these terms. If there is a direct conflict, the specific written agreement will take priority for that service.

03

Connectix account types

Agent account

An Agent is a homeowner who agrees to host a Connectix connection point on their homestead. An authorised Agent may also sell Connectix WiFi tokens.

Reseller account

A Reseller is authorised to sell Connectix WiFi tokens. A Reseller does not become an Agent merely by selling tokens and does not host a connection point unless separately approved as an Agent.

Individual account

An Individual account allows a user to buy Connectix WiFi tokens, use eligible Connectix WiFi services and track WiFi usage linked to the account.

04

Account registration and security

You must provide information that is accurate, current and complete where Connectix asks for it to create or maintain an account.

You are responsible for keeping account credentials, security codes and devices used to access your account reasonably secure. You should notify Connectix promptly if you believe your account has been accessed or used without permission.

You may not create an account using another person's identity without lawful authority, impersonate another person, create misleading account information, or use an account for unlawful activity.

Connectix may request reasonable verification where this is necessary to protect an account, prevent abuse, satisfy legal requirements or administer an Agent or Reseller relationship.

05

Connectix WiFi tokens

A Connectix WiFi token provides access subject to the conditions attached to that token. The applicable conditions may include the service area, data allowance, validity period, device or account requirements, activation conditions and any other information shown when the token is purchased or issued.

A token must be obtained through Connectix or an authorised Agent or Reseller. Users should not rely on tokens obtained from an unauthorised source.

You may not generate, alter, duplicate, counterfeit, manipulate or unlawfully obtain Connectix tokens or attempt to bypass token validation.

Where a token is linked to a particular account, device, service or redemption condition, it may not function outside those conditions.

06

Responsible use of the network

You must use Connectix services lawfully and in a way that does not damage the network, interfere with other users, compromise security or create unreasonable technical risk.

You must not attempt unauthorised access to systems or accounts, distribute malicious software, interfere with network controls, misuse another person's credentials, conduct unlawful activity, or deliberately degrade service for other users.

Additional network rules may be set out in the Connectix Acceptable Use Policy. That policy forms part of these terms where it applies to the service you use.

Read the Acceptable Use Policy

07

Agent and Reseller responsibilities

Only a person or organisation authorised by Connectix may represent themselves as a Connectix Agent or Reseller.

Agents and Resellers must describe Connectix services and tokens accurately, follow approved operating instructions, protect customer and account information, and avoid misleading statements about coverage, token conditions, service performance or their authority.

An Agent must not move, alter, disconnect, tamper with or interfere with a hosted Connectix connection point except as authorised by Connectix.

Connection point placement, equipment responsibilities, access for maintenance, electricity or site requirements, token settlement arrangements and other commercial matters may be governed by a separate Agent agreement.

Token distribution, sales records, settlement arrangements and other commercial matters may be governed by a separate Reseller agreement.

08

Service availability and performance

Connectix aims to provide practical and dependable connectivity, but internet and WiFi services can be affected by factors outside the direct control of Connectix.

Service may be affected by maintenance, equipment faults, upstream network conditions, congestion, power interruptions, environmental conditions, device compatibility, interference, third party infrastructure or events beyond reasonable control.

Coverage in an area does not guarantee identical signal quality or performance at every point or on every device. Actual experience may vary according to the location, equipment and network conditions at the time of use.

Connectix may carry out maintenance, upgrades, repairs or security work where reasonably required to operate or protect the service.

09

Purchases, payments and corrections

The price and conditions applicable to a token or service will be the information presented or otherwise agreed at the time of purchase or order.

You are responsible for checking the service or token details before completing a purchase. Connectix may use third party payment providers and those providers may apply their own terms to payment processing.

If a payment is duplicated, incorrectly processed, or a token cannot be supplied as agreed, Connectix may investigate and correct the affected transaction in accordance with applicable law and the circumstances of the transaction.

Nothing in these terms limits any refund, cancellation, remedy or consumer right that applies under law and cannot lawfully be excluded.

10

Privacy and WiFi usage records

Connectix may process account, token, device, network and WiFi usage information where reasonably required to provide, secure, administer and support the service.

Individual accounts may display WiFi usage information associated with the account. Agents and Resellers may have access only to the information reasonably required for their authorised role.

Personal information is handled in accordance with the Connectix Privacy Policy and applicable data protection requirements.

Read the Privacy Policy

11

Suspension and termination

Connectix may restrict, suspend or terminate access where reasonably necessary to protect the network, respond to fraud or security risk, comply with law, investigate material misuse, prevent harm to other users, or address a serious or repeated breach of these terms.

Where reasonably possible and appropriate, Connectix will give notice and an opportunity to address a breach before permanent termination. Immediate action may be required where there is an urgent security, legal or network risk.

Suspension or termination does not remove rights or obligations that arose before the effective date of suspension or termination.

Separate Agent or Reseller agreements may contain additional rules for ending those relationships.

12

Responsibility and liability

Each party is responsible for complying with these terms and for loss or damage caused by its own unlawful conduct, negligence or breach, subject to applicable law.

To the extent permitted by law, Connectix is not responsible for indirect or consequential loss arising only because internet access was unavailable, delayed or affected by a factor beyond Connectix's reasonable control.

Connectix is not responsible for the content, security, availability or conduct of third party websites, applications or online services that you choose to access through an internet connection.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability or consumer remedies that applicable law does not permit Connectix to exclude.

13

Connectix intellectual property

The Connectix name, branding, website content, software, designs, service interfaces, documentation and other materials are protected by applicable intellectual property rights unless stated otherwise.

You may use Connectix materials only as reasonably necessary to use the service or as expressly authorised by Connectix. Agent and Reseller status does not transfer ownership of Connectix intellectual property.

You may not copy, modify, misuse or represent Connectix branding in a way that falsely suggests a relationship, approval or authority that has not been granted.

14

Changes to these terms

Connectix may update these terms when services, technology, operating practices or legal requirements change.

The latest version will be published on this page with an updated revision date. Where a change materially affects an existing service relationship, Connectix will take reasonable steps to make the change clear before or when it takes effect where required or reasonably practicable.

Changes will not remove rights that have already arisen under applicable law.

15

Applicable law and disputes

These terms are governed by the laws of Zimbabwe, subject to any mandatory rights or protections that apply to you.

If a dispute arises, you should first contact Connectix so that the issue can be reviewed and an attempt made to resolve it directly. This does not prevent either party from using a court, regulator, consumer protection body or other lawful dispute process where available.

If any part of these terms is found to be unlawful or unenforceable, the remaining parts will continue to apply to the extent permitted by law.

Connectix intends these terms to operate consistently with applicable consumer, telecommunications, cyber security and data protection requirements in Zimbabwe, as amended from time to time.

16
